01Acceptance

These Terms of Service (“Terms”) are a binding agreement between you and Zero Soleil (“Zero Soleil”, “we”, “us”), the operator of Dearvell and the website dearvell.zerosoleil.com. By installing, accessing, or using the Dearvell application (package com.zerosoleil.dearvell), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old (or the higher age of digital consent in your country) and able to enter into a binding contract. If you use Dearvell on behalf of an organisation, you confirm that you have authority to bind it.

02The service

Dearvell is an offline-first journal and bookbinding-inspired writing application for Android, distributed through Google Play. It includes local encrypted storage, tactile writing tools, a virtual bookshelf, optional encrypted Google Drive backup, and optional cloud-assisted features. The current feature set, subscription tiers, and limits are described on our pricing page and inside the app.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Dearvell for your own lawful journaling. We do not sell you the software; we license it. You may not copy, modify, distribute, reverse engineer, or create derivative works of the app except as permitted by applicable law or open-source licences included in the app.

03Accounts & Google Drive

Some features require a Dearvell account, created with Google Sign-In or our supported email sign-in. You are responsible for keeping your account credentials and device secure, and for activity that occurs under your account. Tell us promptly if you suspect unauthorised access.

If you enable encrypted Google Drive backup, you authorise Dearvell to use the https://www.googleapis.com/auth/drive.appdata scope solely to create, read, update, and delete its own hidden appDataFolder backup archive. Dearvell does not read your other Drive files. You must connect a Google account you are entitled to use, and you may not attempt to access another person’s backup archive. The Privacy Policy explains encryption, account binding, and the limits of key escrow.

047-Day Full Bindery Trial

New eligible users may receive a 7-day Full Bindery Trial with access to every volume, hide, and room. No credit card is required to begin the trial; signing in is sufficient. The trial does not convert into a paid subscription automatically and does not auto-charge you at the end. When it ends, your account moves to the Free Forever tier unless you separately purchase a Master Bindery Pass through Google Play.

• The trial is available once per Google account and only for accounts that have not previously used a Dearvell trial.
• We may withhold or revoke a trial where we reasonably detect abuse, duplicate accounts, fraud, or attempts to reset eligibility.
• Creating or binding additional diaries during the trial does not create a permanent entitlement. After the trial, the Free Forever rules apply.
• Trial length is measured from activation. We do not pause or extend trials for inactivity.

05Master Bindery Pass

The Master Bindery Pass unlocks unlimited diaries, automated encrypted Google Drive sync, cross-diary links, and the full tactile stationery cabinet for the term you purchase. Current prices in Indian rupees are:

• Monthly Pass — ₹249 per month.
• Annual Pass — ₹2,499 per year.
• Founding Member Annual Pass — ₹1,499 per year, capped at the first 200 eligible seats. The founding rate is a limited promotional allocation, not a permanent guarantee. When the 200 seats are exhausted, the offer closes. Renewal pricing is displayed by Google Play before you renew; if a founding rate is not available at renewal, the standard annual rate applies.

Free Forever and expiry

The first bound volume remains free forever with full read/write access, manual encrypted backup, and core writing. If a paid pass expires or is cancelled, Dearvell enters archival mode: your existing entries, photos, and voice memos remain readable, but additional diaries may become read-only and automated cloud sync may pause. We do not delete your journal because a subscription lapses.

Offline leases

Entitlements are represented by server-signed Ed25519 leases that the app can verify offline. A lease has a limited offline grace period and may need a brief internet check-in to renew. We may suspend paid features if we detect clock tampering, lease forgery, or fraudulent purchase activity. Suspension of paid features does not remove your ability to read existing content.

06Billing, renewal & refunds

Paid subscriptions are sold and processed by Google Play Billing. Your purchase is also subject to Google Play’s terms. Prices are shown in the currency Google Play presents at checkout and may include applicable taxes. We do not receive or store your full payment card details.

• Auto-renewal: paid monthly and annual passes renew automatically unless cancelled at least 24 hours before the end of the current billing period, through your Google Play subscriptions.
• How to cancel: open Google Play → Payments & subscriptions → Subscriptions → Dearvell → Cancel. Uninstalling the app does not cancel a subscription.
• Refunds: refund requests are handled under Google Play’s refund policy and applicable consumer law. We do not separately process card refunds. Nothing in these Terms limits statutory rights you cannot waive.
• Price changes: we may change prices for future billing periods. Google Play will notify you and obtain any consent required before a price change takes effect. A price change does not affect the period you already paid for.
• Free tier: no payment is required to use Free Forever features. Making a purchase is optional.

07Your content

You own the journal entries, titles, photos, voice memos, and other content you create in Dearvell. We do not claim ownership of your words. To operate the features you request, you grant Zero Soleil a limited, worldwide, royalty-free licence to host, transmit, encrypt, decrypt, and process your content solely as necessary to provide the service — for example, to sync an encrypted archive to your Drive or return an optional AI feature’s result. This licence ends when the content is deleted, except for residual encrypted backups and records we must retain by law.

We do not use your journal content to train AI models, sell it, or share it with ad networks. You are responsible for having the rights to any photos, audio, or other material you add, and for keeping your own backups of anything you cannot afford to lose. Dearvell is a journal, not a law firm, medical provider, or emergency service.

08Acceptable use

You agree not to use Dearvell to break the law, infringe another person’s rights, distribute malware, attempt to access another user’s account or backup, probe or bypass security or entitlement controls, abuse trials or refunds, or interfere with the service’s normal operation. You may not use automated means to scrape, overload, or reverse engineer the service, or resell access to it.

We may suspend or terminate an account that materially violates these Terms, creates a security risk, or is used for fraud. Where reasonable and lawful, we will give notice and an opportunity to export readable content. Serious security or legal violations may require immediate action.

09Availability & changes

We work to keep Dearvell available, but the service is provided on an “as available” basis. Offline-first design means your local journal should remain usable without our servers, but Google Drive, Google Play, Firebase, device operating systems, and network operators are outside our control. We may modify, suspend, or discontinue features, provided we do not erase your existing readable entries without a lawful reason and reasonable notice. We may release updates that change the interface or minimum supported Android version.

10Disclaimers & liability

To the maximum extent permitted by applicable law, Dearvell is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that backups will always be available, that Google Drive will never lose data, or that the service will be error-free. You should keep independent copies of important material.

To the maximum extent permitted by law, Zero Soleil is not liable for indirect, incidental, special, consequential, or exemplary damages, loss of profits, loss of goodwill, or loss of data arising from your use of or inability to use the service. Nothing in these Terms excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be excluded under applicable law. Where liability cannot be excluded, our aggregate liability is limited to the amount you paid Zero Soleil through Google Play in the twelve months before the claim, or the minimum permitted by law, whichever is greater.

You agree to indemnify Zero Soleil against third-party claims arising from your unlawful use of the service or your violation of another person’s rights, to the extent permitted by law.

11Governing law & changes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory consumer protections in your country, the courts of India have exclusive jurisdiction over disputes. Before filing a claim, please contact us so we can try to resolve the issue informally.

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and Zero Soleil regarding the service. We may update these Terms; the new version will be posted here with a new effective date, and material changes will be notified in the app before they take effect. Continued use after the effective date means acceptance.

These Terms do not affect rights you have under Google Play’s policies or mandatory local consumer law. In the event of a conflict, the mandatory law prevails.
